Dashcam Video Shows Excessive Force Arrest By Minnesota Cop
On July 28, 2016, Anthony Promvongsa, a 21-year-old Laotian American man, was accused by Worthington Police in southwestern Minnesota of engaging in reckless driving. According to the criminal complaint, Worthington Police Officer Colby Palmersheim alleged that Promvongsa drove aggressively behind his squad car at high speed, tailgating so closely that Palmersheim could not see the hood of Promvongsa’s vehicle. The officer stated that when he moved slightly to allow Promvongsa to pass, the young man swerved toward his car. Palmersheim further reported that Promvongsa continued following him closely, making hand gestures out the window, and allegedly shouted that he would return with “his boys.”Authorities were reportedly already aware that Promvongsa did not have a valid driver’s license, based on prior encounters. Following the alleged incident with Palmersheim, Agent Joe Joswiak of the Buffalo Ridge Drug Task Force pursued Promvongsa. Joswiak stated he activated his emergency lights, but Promvongsa failed to stop, prompting a chase that ended with his arrest. The Buffalo Ridge Drug Task Force, which includes officers from the Worthington Police Department, later filed multiple charges against Promvongsa.Promvongsa was charged with two counts of assault with a deadly weapon—his vehicle—along with fleeing a peace officer in a motor vehicle, possession of a small amount of marijuana, and driving with a revoked license. He has pleaded not guilty to all charges. However, key parts of the officers’ narrative have come under scrutiny. Promvongsa’s attorney, Ginny Barron, emphasized that none of the claims about reckless driving or threatening gestures were captured on dash cam or traffic camera footage. She noted that the case is built entirely on the officers’ accounts, stating, “He maintains his innocence. We intend to try it.”Barron also criticized what she described as a broader pattern of problematic conduct within local law enforcement. “While I believe there are definitely a number of honorable police officers in the community who are highly respected, we are seeing increasing, systemic problems of excessive force in the Worthington Police Department, Nobles County Sheriff’s Office, and Buffalo Ridge Drug Task Force that we don’t believe should ever be allowed or tolerated in a civilized society,” she said.The American Civil Liberties Union (ACLU) released dash cam footage that cast further doubt on the officers’ version of events. The video does not show the alleged reckless driving but begins with Promvongsa pulling over. Agent Joswiak approaches with his gun drawn, yelling profanities and ordering Promvongsa to exit the vehicle. Joswiak then opens the car door and begins pulling Promvongsa, who is apparently still buckled in his seat. Within moments, Joswiak delivers punches and knees to the man before the dash cam audio is mysteriously cut off.The ACLU sharply criticized Joswiak’s use of force. “Promvongsa was not given proper time to obey the officer’s orders before excessive force was used against him,” said Teresa Nelson, executive director of the ACLU of Minnesota. “Agent Joswiak’s use of force against Anthony Promvongsa is disturbing and completely unnecessary.
