Dashcam Shows Fargo Officer Shooting Man Armed With BB Gun
In the early hours of September 28, a serious confrontation occurred in a Fargo parking lot that resulted in a police officer shooting a man who was armed with what appeared to be a handgun. The weapon, later identified as a BB gun with a laser attachment, was pointed at Officer Patrick Thomas of the Fargo Police Department, prompting a tense standoff that ended in gunfire. The incident unfolded in the parking lot of the Pizza Hut located at 4701 13th Avenue South, near the Fargo Wal-Mart. Officer Thomas arrived on the scene in his patrol vehicle, and the dashboard camera in his squad car captured the entire encounter. As Thomas exited the vehicle, he immediately began shouting commands at the suspect, 31-year-old Karmen Redshirt.
According to the footage, Officer Thomas ordered Redshirt multiple times to drop the weapon, shouting at the top of his lungs and warning that he would use deadly force if Redshirt did not comply. Despite nearly 40 seconds of verbal commands and warnings, Redshirt refused to lower the BB pistol. The situation escalated quickly, and Thomas fired three rounds from his service weapon. One of the bullets struck Redshirt in the abdomen, inflicting a serious injury that required surgery and a lengthy period of recovery.Authorities later confirmed that the BB gun Redshirt had been holding closely resembled a real firearm due to its realistic design and the attached laser sight. From a distance, the weapon would have been indistinguishable from an actual handgun, adding to the threat level perceived by Officer Thomas at the time of the confrontation.
Prior to the shooting, Redshirt had led law enforcement officers on a pursuit in a stolen vehicle. His erratic and dangerous behavior during the chase contributed to the heightened sense of danger during the later encounter. Toxicology reports revealed that Redshirt’s blood-alcohol level was 0.279 percent — more than three times the legal limit for operating a motor vehicle in North Dakota, which is 0.08 percent.Following the shooting, the North Dakota Bureau of Criminal Investigation launched an in-depth inquiry into the incident. Cass County State's Attorney Birch Burdick reviewed the findings and determined that Officer Thomas acted within the bounds of the law. Burdick declined to file any criminal charges, concluding that the use of force was justified given the circumstances.
The Fargo Police Department also conducted its own internal review. The department supported the findings of the BCI and ruled that Officer Thomas had acted appropriately during the incident. The decision was based on the perceived threat to the officer’s life and the safety of others in the area.
Despite these official rulings, not everyone agreed with the outcome. Cody Redshirt, Karmen Redshirt’s brother, publicly questioned the officer’s decision to shoot, particularly his choice to fire three rounds. He expressed concerns about whether lethal force was truly necessary in the situation, given that the weapon turned out to be non-lethal.As for Karmen Redshirt, he eventually faced a series of criminal charges related to both the chase and the armed encounter. He pleaded guilty to felony counts of theft, reckless endangerment, and two counts of terrorizing, in addition to a misdemeanor charge of refusing to halt. In court last month, he was sentenced to four years in prison, followed by three years of supervised probation. Redshirt is currently serving his sentence at the North Dakota State Penitentiary. This incident underscores the dangers law enforcement officers face when responding to potentially life-threatening situations. It also raises broader questions about the challenges of split-second decision-making in high-stress encounters and the consequences for both police officers and civilians involved.be.com/embed/yew26h1i4Q8" width="320" youtube-src-id="yew26h1i4Q8">
